1. About Quizy and these Terms
These Terms of Use govern your use of Quizy’s app, website and related services provided by EverNorth Ventures Inc. (“Quizy”, “we”, “us” or “our”). Our mailing address is 419-39 Brant Street, Toronto, Ontario, M5V 0M8, Canada. Contact support@quizy.ca for service questions or privacy@quizy.ca for privacy matters.
This is version 0.1. The published document displays its publication and effective dates. Please read these Terms and the Privacy Policy before using the service. Where an acceptance action is presented, it relates to the exact Terms version shown. A Privacy Policy acknowledgement records that the policy was provided; it is not general consent to all processing. Nothing here removes rights that applicable law makes non-waivable.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter this agreement to participate. Provide accurate account, age and profile information, use only an account you are authorized to control, and keep contact and recovery information current. Do not impersonate another person, misrepresent your age or identity, create accounts to evade restrictions, or transfer or sell access.
Protect your devices and account access. Do not share authentication codes, tokens or credentials. Tell support promptly about suspected unauthorized access. You remain responsible for your own conduct through the service, subject to applicable law; this does not make you automatically liable for every action taken by an unauthorized person.
Contact verification establishes control of a contact method, not a background check, identity guarantee or assurance of safety. We may require verification and eligibility checks appropriate to a feature and may decline or restrict access when requirements are not met.
3. Availability, markets and participation
Quizy supports intentional introductions through member profiles, personal quizzes, Requests and reciprocal connections. Registration, onboarding, Market availability, Discovery eligibility and subscription entitlements are distinct. Features may require completed information, approved content, current eligibility and an available Market. Registration or an invitation does not guarantee Discovery access, a launch date, a particular pool of people or a successful connection.
We may maintain, modify or discontinue features for legitimate operational, safety or business reasons, subject to applicable law and obligations associated with paid purchases. We do not guarantee uninterrupted availability or compatibility with every device. We will not use this clause to remove mandatory consumer remedies or disregard purchased contractual rights.
4. Quizzes, Requests and conversations
Your personal quiz and answers are ways to communicate, not professional assessments or guarantees of compatibility. Submit content you are authorized to share and respect the recipient’s choice about responding. A Request does not oblige another member to answer, reciprocate, connect or continue a conversation.
Submitted exchanges may preserve the exact question versions and answers used at the time. Later edits do not necessarily replace historical interaction content. Profile visibility and access remain subject to current permissions and safety rules. A connection permits supported communication; it does not create a right to another person’s attention, contact details or continued participation.
Use the service’s controls according to their stated effects. Pause, hide, pass, block, unmatch and delete are different actions. Blocking does not necessarily erase retained evidence; unblocking does not promise restoration of a prior interaction; hiding content from your view does not necessarily delete another participant’s copy.
5. Acceptable conduct
Treat others respectfully. Do not harass, threaten, stalk, exploit or coerce anyone; engage in hate or discriminatory abuse; send non-consensual sexual material; impersonate others; commit fraud or solicit money deceptively; distribute unlawful material; or facilitate sexual exploitation or any sexual content involving minors. Do not publish another person’s private information or intimate material without authority.
Do not use Quizy for spam, scams, unauthorized advertising, commercial solicitation, trafficking or other unlawful activity. Do not upload malware, attack the service, bypass access controls or limits, scrape member information, automate interactions without permission, reverse engineer contrary to applicable law, or use service content to build unauthorized datasets or train models.
Do not misuse reports, make knowingly false safety allegations, evade enforcement through new accounts, or attempt to access information you are not entitled to receive. Do not infringe intellectual property or privacy rights. These rules apply to profiles, photographs, questions, answers, invitations, messages and interactions with support.
6. Personal safety and member interactions
You decide whether and how to interact with another member, share information or meet offline. Use care, avoid sending money or financial credentials, and consider meeting in public and telling someone you trust about your plans. Quizy does not supervise offline meetings or guarantee any member’s statements, intentions or conduct. The service is not an emergency service; contact local emergency services when immediate help is needed.
Reporting, blocking and other safety controls are available independently of paid status. Reports are requests for review and do not automatically establish wrongdoing or trigger a ban. We may review reported material and necessary context under scoped access protections. We do not promise a particular investigation result, response time or individual outcome notice for every report.
7. Content review and enforcement
We may hold, reject or withdraw content, limit features, restrict accounts or terminate access where reasonably necessary to enforce these Terms, protect people or the service, or comply with law. Configured automated checks and authorized human review can make mistakes. Contact support@quizy.ca if you believe a decision is incorrect or need help understanding available account actions.
We aim to limit access to sensitive content to authorized purposes. We may be unable to disclose reporter identities, another person’s information, confidential safety evidence or security-sensitive details. These Terms do not authorize unrestricted administrative browsing of private conversations or remove duties imposed by privacy law.
8. Your content and our limited licence
You retain ownership of content you submit, subject to the rights of others. You represent that you have the permissions needed to supply it and allow its use as described here. Do not upload content on behalf of someone else without authority.
You grant EverNorth Ventures Inc. a non-exclusive, royalty-free licence to host, store, reproduce, encrypt, format, transmit and display your content only as reasonably needed to operate Quizy, deliver it to authorized recipients, provide support and safety review, and meet applicable legal obligations. We may allow service providers to perform these functions for us under appropriate restrictions. This licence is not permission to sell your private messages, use your likeness in advertising without separate permission, or exploit content for unrelated purposes.
The licence continues only to the extent necessary for those purposes, including permitted historical exchanges and legitimately retained records after deletion. It ends for content when no authorized service or retention purpose remains. Privacy rights and deletion obligations continue to apply; technical immutability does not establish indefinite retention rights.
9. Subscriptions and purchases
Quizy may offer Basic and Paid features. The purchase screen identifies the applicable price, billing period, renewal terms and included benefits before purchase. Availability, eligibility and limits can vary; no subscription guarantees matches, replies or a particular outcome. Additional prices or benefits are not created by these Terms alone.
Purchases through Apple are processed through your Apple account under the disclosed purchase terms and Apple’s applicable rules. Auto-renewal, where offered and selected, continues according to those terms unless cancelled through Apple’s subscription settings. Manage cancellation there; deleting the Quizy app or account does not itself cancel an Apple subscription. Cancellation normally prevents future renewal, while remaining access depends on the purchase terms and applicable law.
Refund requests for Apple-billed purchases are handled through Apple’s applicable process, subject to your statutory rights. We do not impose a blanket no-refund rule. Contact support for entitlement or restoration problems; purchase verification may be required. We do not promise that purchases can be transferred between unrelated Quizy or Apple accounts.
10. Invitations and program participation
Invitations, Ambassador participation and referral benefits are subject to their displayed eligibility, availability and program conditions. An invitation does not guarantee approval, permanent privileges, payment or a Market launch date. Do not sell invitations, misrepresent your relationship with Quizy or use referrals for spam. We may correct abuse or invalid grants while respecting legitimate accrued rights and applicable law.
11. Privacy and communications
The Privacy Policy explains our handling of personal information, sharing, safeguards and requests. Visibility choices and recipient access matter: another member may copy information you intentionally disclose. Do not use another member’s information beyond the interaction purposes for which it was made available.
We may send necessary account, security, verification, transactional and service communications. Optional social notifications follow available preferences and device permissions. These Terms do not constitute consent to unrelated marketing or new sensitive-information purposes.
12. Leaving Quizy and account deletion
You may stop using Quizy and request account deletion through the supported account or public deletion process. We may require proportionate verification before an irreversible deletion. Uninstalling the app, signing out and pausing Discovery are not account deletion.
Deletion revokes access and removes personal data that no longer has an authorized purpose, with limited lawful retention and historical effects described in the Privacy Policy. Another person’s independent copies cannot necessarily be recalled. Any retained information remains subject to applicable access, protection and disposal obligations. Subscription cancellation remains separate.
Termination does not eliminate obligations or claims that properly survive, including unpaid lawful charges, relevant content permissions for legitimately retained material, intellectual-property protections and applicable dispute provisions. This does not create an indefinite licence or retention entitlement.
13. Quizy intellectual property and third-party services
Quizy’s software, branding and service materials are owned by EverNorth Ventures Inc. or its licensors, except for member content and third-party materials. We grant you a limited, personal, revocable right to use the service as permitted by these Terms and applicable law. Do not imply endorsement or use our marks without permission.
Third-party services, app stores and linked websites have their own terms and practices. We are responsible for our own obligations but cannot promise the availability or independent conduct of third-party services. Applicable open-source and third-party licences continue to govern their materials.
14. Disclaimers and liability
To the extent permitted by applicable law, the service is provided on an as-available basis without guarantees of uninterrupted operation, error-free content, a particular introduction or relationship outcome, or another member’s identity and conduct. We do not provide legal, medical, psychological or other professional advice through member quizzes or interactions.
To the extent permitted by law, we are not responsible for losses caused solely by another member’s independent conduct or events outside our reasonable control, and we exclude liability for indirect or consequential loss where such exclusion is lawful. These provisions do not excuse our own obligations where liability cannot lawfully be excluded, including applicable consumer and privacy protections, fraud or wilful misconduct. No arbitrary monetary liability cap is imposed by these Terms.
15. Disputes and governing law
Contact support@quizy.ca to seek resolution of a service dispute, or privacy@quizy.ca for a privacy concern. An attempt at informal resolution does not prevent urgent relief, a regulator complaint, a statutory remedy or a claim within an applicable limitation period.
Ontario law and the applicable federal laws of Canada govern these Terms, subject to mandatory protections that apply where you live. Courts in Ontario may hear disputes, without preventing you from using a court or forum available under non-waivable law. We do not require binding arbitration or waive your right to participate in a class proceeding where available. Applicable statutory consumer rights take priority over conflicting wording.
16. Changes and general provisions
We publish updated Terms with their version and effective date and provide additional notice or request agreement where required. A publication, notice delivery or version increment does not itself prove your acceptance. Changes do not silently rewrite historical versions or retroactively remove accrued mandatory rights.
If a provision is unenforceable, the remaining provisions continue to the extent lawful. A failure to enforce a provision immediately is not a permanent waiver. You may not transfer your account or obligations without permission. Any transfer by us remains subject to applicable law, privacy obligations and your non-waivable rights. These Terms and applicable purchase or feature terms govern the relevant service; a more specific term cannot remove mandatory protections.
